These terms and conditions (the "Terms") govern your use of rcgestatesconstruction.com (the "Site"), operated by RCG Estates Construction & Development ("RCG Estates", "we", "us"). By accessing or using the Site you agree to these Terms. If you do not agree, please do not use the Site.

Use of the Site

The Site presents our custom-home and commercial construction services, examples of our work, client reviews and articles, and lets you contact us to request a consultation. You may use the Site for lawful, personal and business purposes related to evaluating our services. You agree not to interfere with the Site's operation, attempt to gain unauthorized access to it or the systems behind it, submit false or misleading information, or use automated tools to copy the Site's content.

Consultations, estimates and contracts

Information on the Site — including service descriptions, photographs, timelines and any figures — is provided for general information and does not constitute an offer, a quote or a guarantee of a particular result, price or schedule. A free consultation is an opportunity to discuss your project; any estimate we prepare is preliminary until it is confirmed in a written agreement.

All construction, design and related services are performed only under a separate written contract signed by both parties. That contract, not these Terms, governs the scope, price, schedule, warranties and other terms of your project. If anything on the Site conflicts with your contract, the contract controls.

Our content

The text, photographs, logos, graphics and design of the Site are owned by RCG Estates or used with permission, and are protected by copyright and trademark law. Project photographs show homes and buildings we built for our clients and are shown with their agreement. You may view and print pages for your own reference, but you may not reproduce, distribute, modify or use the Site's content for any commercial purpose without our written consent.

Client reviews and testimonials reflect the personal experience of the people who wrote them. Results vary with each project, site and budget.

Your submissions

When you send us a message, photos or plans through the Site or by email, you confirm that you have the right to share them and you allow us to use them to evaluate and respond to your request. How we handle your personal information is described in our Privacy Policy.

Third-party links and services

The Site contains an embedded Google Map and links to Google, Facebook and Instagram, and may link to other websites we do not operate. Those sites have their own terms and privacy practices. We provide the links for convenience and are not responsible for their content or availability.

Disclaimer of warranties

The Site is provided "as is" and "as available". While we work to keep its content accurate and current, we make no warranties, express or implied, about the Site's completeness, accuracy, reliability or availability, or that it will be free of errors, interruptions or harmful components. Nothing in this section limits the warranties we give you under a signed construction contract.

Limitation of liability

To the fullest extent permitted by law, RCG Estates and its owners, employees and contractors will not be liable for any indirect, incidental, consequential or punitive damages, or for any loss of profits, data or business opportunity, arising from your use of or inability to use the Site or from reliance on its content. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnity

You agree to defend and hold harmless RCG Estates from claims, damages and expenses (including reasonable attorneys' fees) that arise from your misuse of the Site or your violation of these Terms.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute relating to the Site will be brought in the state or federal courts located in Hidalgo County, Texas, and you consent to their jurisdiction.

Changes to these Terms

We may revise these Terms at any time by updating this page. The date at the top shows the latest revision. Your continued use of the Site after a change means you accept the revised Terms.
